WINDURO YACHTING – TERMS & CONDITIONS

Conditions for Courses, Training, Reservations, Payments, Cancellations and Liability

 

1. General Information

Winduro Yachting (hereinafter referred to as “Winduro Yachting”, “we”, “us”, or “our”) provides sailing and skipper training courses and related educational services in the Republic of Croatia.

By submitting an application, making a reservation, or participating in any course or service, the client (“Client”, “Participant”, “you”) confirms that they have read, understood, and fully accepted these Terms & Conditions.

2. Reservation Policy

  1. A reservation is considered tentative until the required deposit payment has been received in accordance with Section 3 (Payment Terms).

  2. Course places are limited and allocated on a first-come, first-served basis.

  3. All reservation confirmations and official communication will be sent to the email address provided by the Client during the booking process.

3. Payment Terms

  1. To secure a course reservation, the Client is required to make payments under the following conditions:
    a. A 50% deposit of the total course fee must be paid within 7 days from the date of application.
    b. The remaining 50% balance of the course fee must be paid on the first day of the course, prior to course commencement.

  2. Payments must be made exclusively via bank transfer using the details provided in the payment instruction email:

    • Account holder: Winduro Yachting

    • IBAN: [IBAN]

    • Bank: OTP Bank

    • Payment reference: Client Name – Course Name – Course Date

  3. Winduro Yachting reserves the right to release the reserved place without further notice if payment deadlines are not respected.

4. Client Cancellation & Date Changes

4.1 Cancellation by the Client

  1. A full refund of the deposit will be issued if written cancellation is received at least 30 days before the scheduled course start date.

  2. Cancellations made less than 30 days before the course start date will result in the deposit being non-refundable.

  3. All cancellations must be submitted in writing via email. The date of receipt of the email will be considered the official cancellation date.

  4. Failure to attend the course without prior written notice will be considered a no-show, and no refund will be issued.

4.2 Course Date Changes

  1. Requests for course date changes must be submitted in writing at least 30 days before the original course start date.

  2. Date changes are subject to availability and approval by Winduro Yachting.

  3. Winduro Yachting reserves the right to charge an administrative fee for approved date changes.

5. Cancellation or Changes by Winduro Yachting

  1. Winduro Yachting reserves the right to modify, postpone, or cancel a course due to:

    • adverse weather conditions,

    • safety or technical reasons,

    • insufficient number of participants,

    • other justified operational circumstances.

  2. In the event of cancellation by Winduro Yachting, the Client will be offered either:

    • a full refund of all payments made, or

    • the option to transfer payments to an alternative course date.

  3. Winduro Yachting is not responsible for any additional costs incurred by the Client, including travel, accommodation, or personal expenses.

6. Responsibility and Risk

  1. Participation in all courses and activities is undertaken at the Client’s own risk.

  2. Winduro Yachting shall not be held liable for injury, loss, damage, or expense incurred during the course, except in cases of proven gross negligence.

  3. Clients must follow all safety instructions and guidance provided by instructors and skippers at all times.

7. Data Protection (GDPR)

  1. Personal data is collected solely for course reservation, communication, and service delivery purposes.

  2. Winduro Yachting will not share personal data with third parties except where required to fulfill contractual or legal obligations.

  3. Clients have the right to access, correct, or request deletion of their personal data in accordance with applicable data protection regulations.

8. Pricing Policy

  1. All prices are stated in EUR, unless otherwise specified.

  2. Winduro Yachting reserves the right to change prices at any time; however, confirmed reservations will not be affected by price changes.

9. Career Opportunities Disclaimer

  1. Winduro Yachting may, at its sole discretion, offer successful course participants the opportunity to:

    • gain additional practical experience,

    • be recommended for professional engagements,

    • or be considered for future collaboration through Winduro Yachting or its partner network.

  2. Such opportunities are not guaranteed and depend on individual performance, professionalism, and operational demand.

  3. Completion of a course does not constitute an offer of employment or a guarantee of work or income.

10. Disclaimer

Winduro Yachting does not guarantee specific outcomes following course completion, including employment, certification by third parties, or professional placement.
All courses are conducted in accordance with industry safety standards and best professional practices.

11. Governing Law and Jurisdiction

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of Croatia.
Any disputes shall fall under the jurisdiction of the competent court in Croatia.

12. Participant Benefits – Partner Discount

  1. All participants of Winduro Yachting courses are entitled to a 15% discount at Adria Libar Sailing School.

  2. The discount applies exclusively to services provided by Adria Libar Sailing School and is subject to their terms and availability.

  3. Winduro Yachting is not responsible for the organization or delivery of partner services and reserves the right to modify or discontinue this benefit without prior notice.
